1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of Background Remover Video (the "Service," "we," "us," or "our").

By using the Service, creating an account, or making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for an organization, you confirm that you have authority to accept these Terms for that organization.

2. What the Service Does

Background Remover Video uses AI to remove backgrounds from videos. Depending on the options you choose, you can create a transparent video or replace the original background with a solid color, select an available output format, preserve the original audio, and adjust subject framing.

Results depend on the source video. Lighting, motion, subject detail, image quality, overlapping objects, and other factors may affect accuracy and visual quality. You are responsible for reviewing a result before publishing or relying on it.

3. Who May Use the Service

You must be at least 13 years old and meet any higher minimum age required where you live. If you have not reached the legal age to enter a contract, you may use the Service only with permission from a parent or legal guardian.

You may not use the Service if applicable law prohibits you from doing so.

4. Accounts and Security

Some features require an account. You agree to provide accurate information and keep it current. You are responsible for protecting your sign-in details and for activity through your account, except where the activity results from our failure to meet these Terms or applicable law.

Tell us promptly if you suspect unauthorized access. You must not impersonate another person, share access in a way that puts the Service at risk, or create accounts through unauthorized automated methods.

5. Your Videos and Other Content

You keep all rights you have in videos, messages, feedback, and other material you submit ("User Content"). You must have every right and permission needed to upload, process, and use that content, including permission from people who appear or can be heard in it where required.

You give us a worldwide, non-exclusive, royalty-free permission to host, copy, process, transmit, format, and otherwise use User Content only as reasonably necessary to:

• Provide the video-processing result and other features you request
• Operate, secure, troubleshoot, and improve the Service
• Prevent misuse and enforce these Terms
• Comply with applicable law

This permission lasts while the content is being handled by the Service and for any limited additional period needed for security, dispute resolution, or legal compliance.

You remain responsible for User Content and for how you use or share any result.

6. Acceptable Use

You must not use the Service to upload, create, process, promote, or distribute:

• Content you do not have permission to use
• Illegal, fraudulent, deceptive, or abusive material
• Pornographic or sexually explicit material
• Sexual exploitation or abuse of minors, or any material that promotes it
• Harassment, hate, discrimination, credible threats, or violence
• Content that violates intellectual property, privacy, publicity, confidentiality, or other rights
• Malware, harmful code, or material intended to damage systems or data

You also must not:

• Interfere with the security, availability, or operation of the Service
• Try to access another user's account, files, or results
• Bypass credit charges, usage controls, or safety measures
• Use unauthorized scraping, probing, reverse engineering, or automated access
• Resell or commercially exploit access to the Service unless we have agreed in writing
• Help another person do anything prohibited by these Terms

We may investigate suspected violations and remove content, limit features, suspend accounts, or end access when reasonably necessary.

7. AI Results and Quality

AI processing is not perfect and may produce incomplete, inaccurate, unexpected, or visually imperfect results. Results may differ between videos or repeated requests. We do not guarantee that a result will meet every creative, technical, legal, or commercial requirement.

You are responsible for checking that a result is suitable and lawful before using, publishing, selling, or distributing it.

8. Credits and Purchases

Credit packs are one-time purchases and do not renew automatically.

• One credit pays for each started second of video processing. For example, a video lasting 10.1 seconds uses 11 credits.
• The required amount is shown before you start processing.
• Purchased credits do not expire. They remain tied to your account, cannot be transferred, have no cash value, and cannot be redeemed for cash.
• If processing fails after credits have been deducted, the full number of credits charged for that task is automatically returned to your account.
• Credits are not returned for a successful task merely because you do not like the result or did not download it in time, except where required by law or stated otherwise at purchase.

Prices, included credits, currency, taxes, and other purchase details are shown before checkout. You authorize the payment service to charge the selected payment method for the amount shown.

Refunds are governed by the information shown at purchase and applicable law. Nothing in these Terms limits a refund or consumer right that cannot legally be limited.

9. File Availability

Uploaded videos and processed results are automatically removed from the Service after 7 days. You are responsible for downloading results you want to keep before they are removed. We cannot restore a file or result after it is no longer available.

10. Our Intellectual Property

The Service, including its software, design, text, graphics, and branding, is owned by us or our licensors and protected by law. These Terms give you only the limited right to use the Service as described here. They do not transfer ownership of the Service or its branding to you.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service unless applicable law permits it or we give written permission.

11. Other Services

The Service relies on other services for features such as sign-in, payment, communication, and video processing. Your use of those services may also be governed by their own terms and privacy policies. We are not responsible for services we do not control.

12. Changes and Availability

We may add, change, limit, suspend, or discontinue parts of the Service. We will respect any rights that applicable law gives you in relation to a purchase.

We do not promise that the Service will always be available, uninterrupted, error-free, secure, or compatible with every file, browser, device, output format, or intended use.

13. Suspension and Termination

You may stop using the Service at any time. To request account deletion, email support@backgroundremover.video.

We may restrict, suspend, or end access if we reasonably believe that you violated these Terms, created a security or legal risk, failed to pay an amount due, harmed other users or the Service, or if we are required to act by law. We may act immediately in urgent cases involving fraud, illegal activity, sexual exploitation, security, or risk of harm.

When your account is deleted or terminated, your right to use remaining credits and account features ends. Terms that by their nature should continue will remain in effect, including those concerning content responsibility, intellectual property, payment obligations, disclaimers, liability, and disputes.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from prior dealings or usage.

We do not guarantee that results will be accurate, unique, free of third-party claims, or suitable for your needs. Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by law, we and the services that support Background Remover Video will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, content, or business opportunities arising from or related to the Service.

To the maximum extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of the amount you paid to the Service during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

These limitations do not apply to liability that cannot legally be limited.

16. Indemnity

To the extent permitted by law, you agree to defend and indemnify us against third-party claims, losses, liabilities, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement of another person's rights.

This section does not require a consumer to indemnify us where applicable consumer law prohibits it.

17. Governing Law and Disputes

These Terms are governed by the laws that apply to the operator of the Service and your relationship with the Service, without removing mandatory protections available where you live.

Before filing a formal claim, you and we agree to try to resolve the issue informally. Send a written description of the issue to the email below. Either party may seek urgent relief where appropriate, and an unresolved dispute may be brought before a court or tribunal with lawful authority over it.

These Terms do not require arbitration or waive any right that cannot lawfully be waived.

18. Changes to These Terms

We may update these Terms when the Service, law, security needs, or business operations change. We will post the updated Terms on this page and revise the date above. We will provide additional notice when required by law.

19. General

These Terms, together with policies and purchase terms expressly included in them, form the agreement concerning the Service. If a provision cannot be enforced, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, financing, reorganization, or transfer of the Service, subject to applicable law.
